ECUPROGRAM™ a division of ACHA Corporation, also known as ecuprogram.com (collectively hereinafter referred to as "ecuprogram.com" reserves the right, at any time, to modify, amend, alter or update these Terms of Use, and you agree to be bound by such modifications, amendments, alterations or updates.
1) DISCLAIMER:
Proper service and repair procedures are vital to the safe, reliable operation of all motor vehicles as well as the personal safety of those performing the repairs. Standard safety procedures and precautions (including use of safety goggles and proper tools and equipment) should be followed at all times to eliminate the possibility of personal injury or improper service which could damage the vehicle or compromise its safety.
Although this material has been prepared with the intent to provide reliable information, no warranty (express or implied) is made as to its accuracy or completeness. Neither is any liability assumed for loss or damage resulting from reliance on this material. SPECIFICALLY, NO WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR ANY OTHER WARRANTY IS MADE OR TO BE IMPLIED WITH RESPECT TO THIS MATERIAL. In no event will ecuprogram.com, its employees, or its parent or affiliates be liable for any damages, direct or indirect, consequential or compensatory, arising out of the use of this material.
Please remember that modifing a car outside its normal o.e.m status, software or hardware, could be risky. ALL MODIFICATION CONTAINS SOME LEVEL OF RISK, AND THAT RISK IS ASSUMED BY THE CUSTOMER.
THE INFORMATION, PRODUCTS, MATERIALS AND SERVICES CONTAINED IN THIS SITE, INCLUDING WITHOUT LIMITATION, GRAPHICS, TEXT AND LINKS ARE PROVIDED ON AN "AS IS" BASIS WITH NO WARRANTY OF MERCHANTABILITY, FITNESS FOR A SPECIFIC USE OR REPRESENTATION OF ACCURACY.
2) LIMITATION OF LIABILITY:
IN NO EVENT SHALL ecuprogram.com BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, CONSEQUENTIAL OR ANY OTHER DAMAGES WHATSOEVER, WHETHER IN ACTION OR UNDER CONTRACT, TORT OR OTHERWISE. Under no circumstance, including, but not limited to, negligence, shall ecuprogram.com be liable for any damages that result from the use of, or inability to use, the information, materials or products contained in or purchased. Further, ecuprogram.com shall have no liability or responsibility for any delay in the delivery, installation or use of the products, as well as the service life of the products, performance, applicability for the use intended, proper installation, or the accuracy of information provided. ecuprogram.com will not be responsible for lost or stolen packages, nor damage caused by our products to other parts on the vehicle.
ecuprogram.com has no liability for any computer virus or other computer disruptions or damages to any software or hardware of any user of this site.
3) EXTERNAL SITES
This site may contain links to other sites that are owned and operated by third party vendors and others. You acknowledge that ecuprogram.com is not responsible for the availability, content, texts, graphics, information or any actions or damages from any external site. You must contact the site administrator or Webmaster for those sites if you have any concerns regarding those links.
4) PRIVACY
Our dedication is to you, our customers. We value the trust you place in ecuprogram.com. Accordingly, it is our top priority to ensure that your experience at ecuprogram.com is safe and private. ecuprogram.com does not sell, rent, or loan any personal information about its customers to any outside party at any time. All personal information that you provide to ecuprogram.com is held in the strictest confidence, and is used solely to improve our service to you, the customer.
Europrogram Warranty Information:
The hardware that fails within this 3 month warranty period will be repaired or replaced at ecuprogram.com's option, when determined by ecuprogram.com that the product failed due to defects in material or workmanship. This warranty is limited to the repair or replacement of the ecuprogram.com part. In no event shall this warranty exceed the original purchase price of the ecuprogram.com part nor shall ecuprogram.com be responsible for special, incidental or consequential damages or cost incurred due to the failure of this product. If the product is professionally installed, the products will be warranted for a period of twelve months. Written proof of the installation that includes date of install is required to verify warranty claims. Warranty claims to ecuprogram.com must be transportation prepaid and accompanied with dated proof of purchase. This warranty applies only to the original purchaser of the product and is non-transferable. All implied warranties shall be limited in duration to the said 3 months warranty period. Improper use or installation, use for racing, accident, abuse, unauthorized repairs or alterations voids this warranty. ecuprogram.com disclaims any liability for consequential damages due to breach of any written or implied warranty on all products manufactured by ecuprogram.com. Warranty returns will only be accepted by ecuprogram.com when accompanied by a valid Return Merchandise Authorization (RMA) number. Credit for defective products will be issued pending inspection. Product must be received by ecuprogram.com within 15 days of the date RMA is issued. If you have a warranty issue, please email contact(at)ecuprogram.com and a customer service representative will assist you. A proof of purchase is required for all ecuprogram.com warranty claims.
ECU Remapping: The numbers shown on advertised products may not be simular on other vehicles. All vehicles are maintained and perform differently. ecuprogram.com cannot guarentee exact or simular results from one car to another because of that. We will do our best to process the safest and most power out of the tuning as possible. We cannot be held responsible for different cars representing numbers on different dynos at different times of the year in which atmospheric conditions could alter the results.
Returns & Refunds:
If you are not completely satisfied, return the new/unused item in the original box prepaid within 15 days, with a copy of the invoice/receipt, for a refund/exchange. When making a return, please remember a few rules of thumb and your return can be processed as quickly as possible.
- There are NOT returns will be accepted without a copy of the original invoice / receipt.
- Free re-flashes are for original purchaser of the tune and do not follow the car when it changes hands.
- All DME/ECU's must be sent to ecuprogram.com Calgary, AB for re-flash to stock file before any refund will be processed.
- All custom tuning sales are FINAL.
- There are NOT refunds will be given for custom tuning, dyno time / rental.
- Refunds on restock fees are %15.

No refunds will be given on handling/shipping charges. Neither COD or freight-collect shipments will be accepted.
